RESOLUCION N° 1206/92 EX SENASA
DEROGADA POR RESOLUCION RZ 218/95 (7-4-95)
BUENOS AIRES, 30 de diciembre de 1992
VISTO la resolución N° 304 del 1 de abril de 1992, por la cual se establecieron los
mecanismos a aplicarse en caso de detectarse sustancias anabólicas, tirostáticas
u hormonales en ganados con destino a faena para exportación a la COMUNIDAD
ECONOMICA EUROPEA, y
CONSIDERANDO:
Que habiéndose analizado en forma puntual las sanciones establecidas por
contravenir las normas fijadas al respecto, surge que si bien tiendan a garantizar el
estricto cumplimiento de la resolución N° 28 del 3 de enero de 1992, las mismas
no se compadecen con la gravedad de los hechos que pueden ocasionar su
contravención.
Que corresponde en consecuencia modificar en forma parcial la mencionada
resolución fijando pautas más severas para los casos en que se compruebe en
forma fehaciente el incumplimiento de la precitada norma legal.
Que el suscripto es competente para resolver en esta instancia de conformidad
con las facultades conferidas por el artículo 11 inciso l) de la Ley 23.899.
Por ello
EL ADMINISTRADOR DEL
SERVICIO NACIONAL DE SANIDAD ANIMAL
RESUELVE:
ARTICULO 1°.- Modificar el artículo 1° de la Resolución N° 304/92, el cual
quedará redactado de la siguiente manera:
"ARTICULO 1°.- Ante la constatación de casos positivos de anabólicos, tirostáticos
u hormonales en bovinos que contravengan lo estatuido por resolución N° 28 del 3
de enero de 1992, este Servicio procederá de la siguiente manera:
a) en el caso de que muestras recepcionadas en playas de faena y analizadas
por la GERENCIA DE DIAGNÓSTICOS, CONTROL Y METODOS o el
laboratorio habilitado a tal efecto dieran resultado negativo, la muestra será
archivada como testimonio de monitoreo.
b) Si el resultado es positivo, la GERENCIA DE DIAGNÓSTICOS, CONTROL Y
METODOS informará a las GERENCIAS DE SERVICIOS DE INSPECCION
DE PRODUCTOS ANIMALES Y DE LUCHAS SANITARIAS la novedad, y a
través de éstas a los respectivos Servicios.
c) Al establecimiento cuyo análisis diera positivo, se lo inhabilitará para
comercializar hacienda con destino a faena para exportación a COMUNIDAD
ECONOMICA EUROPEA, por el término de UN (1) año, sin perjuicio de las
acciones penales que correspondan.
�d) Todo lo actuado será elevado a la SUBGERENCIA DE ASUNTOS JURIDICOS
a fin de iniciar las acciones legales pertinentes.
e) Vencido el plazo de inhabilitación los establecimientos agropecuarios podrán
solicitar su rehabilitación, la cual será concedida por la GERENCIA DE
DIAGNOSTICOS, CONTROL Y METODOS previo muestreo a campo de DOS
(2) pruebas negativas consecutivas como mínimo."
ARTICULO 2°.- La resolución N° 304 del 1 de abril de 1992 mantendrá vigente sus
restantes aspectos.
ARTICULO 3°.- Comuníquese, publíquese, dése a la Dirección Nacional del
Registro Oficial y archívese.

RESOLUCIÓN EX SENASA 1492/94
BUENOS AIRES, 16 Diciembre 1994
VISTO la propuesta de la GERENCIA DE LUCHAS SANITARIAS en el sentido que
sea declarada zona infestada de Triquinosis a la Provincia DE SANTA CRUZ, y
CONSIDERANDO:
Que tal medida está fundamentada en los focos de triquinosis registrados en los
Departamentos de GUER AIKE noviembre y diciembre de 1993 y PUERTO
DESEADO en abril de 1994, lo que evidencia una amplia distribución de esta Zoonosis
en la mencionada Provincia.
Que el CONSEJO AGRARIO PROVINCIAL de la Provincia de SANTA CRUZ
manifiesta su conformidad con dicha medida.
Que el alto grado de riesgo para la salud pública radica en que la producción porcina
aunque poco relevante _ se desarrolla en explotaciones de tipo familiar en los
alrededores de los. centros urbanos, en circunstancias que .no reúnen las condiciones
higiénico - sanitarias requeridas.
Que por resolución N° 839/58 de la SECRETARIA de AGRICULTURA, GANADERIA
Y PESCA DE LA NACION (en la actualidad SECRETARIA DE AGRICULTURA,
GANADERIA y PESCA) declaró zona.
infestada de Triquinosis Porcina al
Departamento de GUER AIKE de la Provincia de SANTA CRUZ.
Que de los antecedentes epidemiológicos de la referida provincia surge que durante los
últimos DIEZ ( 10) que años, la GERENCIA DE LUCHAS SANITARIAS dependiente
del SERVICIO NACIONAL DE SANIDAD ANIMAL ha intervenido al menos una vez
cada año, ante la notificación de focos de triquinosis.
Que la situación señalada requiere la adopción de urgentes y severas medidas de
prevención y control.
Que la Triquinosis porcina, por el Decreto N° 40571 del 26 de diciembre de 1947 otorga a
la autoridad sanitaria competente la facultad de declarar zonas infestadas de Triquinosis
Porcinas, cuando la gravedad de las circunstancias así lo requiera.
Que atento a ello y en virtud de las atribuciones conferidas, el suscripto está facultado para
resolver en esta instancia, de acuerdo a lo establecido en la Ley 23899, en la Ley N° 30 del
7 de enero de 1994, fue incluida en la nómina a que se refiere el artículo 6° de la Ley N°
3959 de Policía Sanitaria de los Animales, y en los Decretos Nros 30 del 7 de enero de
1944 y 40571 del 26 de diciembre de 1947.
Por ello
EL ADMINISTRADOR GENERAL DEL
SERVICIO NACIONAL DE SANIDAD ANIMAL
RESUELVE:
ARTICULO l°.- Declárase zona infestada de Triquinosis Porcina al territorio de la
Provincia de SANTA CRUZ.
ARTICULO 2°.- Facultase' a la GERENCIA DE LUCHAS SANITARIAS dependiente de
éste Servicio Nacional para adoptar las medidas establecidas en la Ley N° 3959 de Policía
�Sanitaria de los Animales y en los Decretos Nros 30/44 y 40571/47 para el control y
erradicación de la Triquinosis Porcina.
ARTICULO 3°.- Comuníquese, publíquese, dése a la Dirección Nacional del Registro
Oficial y archivese.
