EX SENASA N° 579/92 BOLETIN OFICIAL N° 27.442 del 3/8/92 Cambia el N° de apartado por Res. 533/94 BUENOS AIRES, 23/07/92 VISTO el expediente n° 5.944/91 del registro del SERVICIO NACIONAL DE SANIDAD ANIMAL, mediante el cual el Laboratorio Regional Mar del Plata, dependiente de la GERENCIA DE DIAGNOSTICOS, CONTROL Y METODOS (DICOM), solicita se incorpore un nuevo apartado al Capítulo XXIII del Reglamento de Inspección de Productos, Subproductos y Derivados de Origen Animal, aprobado por Decreto n° 4.238 de fecha 19 de julio de 1968, en el cual se contemple la obligatoriedad del análisis a toda partida e moluscos bivalvos y gasterópodos, y CONSIDERANDO: Que de acuerdo a experiencias realizadas en la práctica, resulta necesario establecer la exigencia de llevar a cabo el bioensayo a toda materia prima que se importe y/o exporte, asimismo la destinada a consumo interno. Que atendiendo a estas finalidades mencionadas, resulta un factor esencial para el cumplimiento del orden sanitario no sólo la adecuada implementación de esta medida, sino la eficiente fiscalización en el orden técnico a lo largo de la Costa Atlántida, tomando como base para evaluar este fenómeno, las 400 U.R., usadas internacionalmente. Que resulta imprescindible tener en cuenta las normas que rigen en la materia, recomendadas por organismos internacionales. Que la Comisión Permanente de Estudio y Actualización del Reglamento de Inspección de Productos, Subproductos y Derivados de Origen Animal ha efectuado el análisis de la normativa, proponiendo el texto del nuevo apartado a incluir en el numeral 23.2.15, que considera adecuado para cubrir el vacío reglamentario sobre el tema de referencia. Que el suscripto es competente para resolver en esta instancia, en virtud de las facultades conferidas en la Ley 23.899. Por ello, EL ADMINISTRADOR GENERAL DEL SERVICIO NACIONAL DE SANIDAD ANIMAL RESUELVE: ARTICULO 1°.- Apruébase la incorporación del apartado o) al numeral 23.2.15 del Reglamento de Inspección de Productos, Subproductos y Derivados de Origen Animal (Decreto 4.238/68) que quedará redactado de la siguiente manera: "PRODUCTOS IMPROPIOS PARA EL CONSUMO: "23.2.15 o) Los moluscos (bivalbos y gasterópodos) crudos, que se destinen a consumo directo o "industrialización, que a la investigación de "Toxina paralizante de la moluscos (T.P.M.)" arrojen un título tóxico "igual o superior a CUATROCIENTAS (400) UNIDADES RATON (U.R.) por el método de la ASSOCIATION "OF ANALYTICAL CHEMISTS (A.O.A.C.) u otro similar equivalente." "A tal efecto, el SERVICIO NACIONAL DE SANIDAD ANIMAL (SENASA) queda facultado para efectuar "los muestreos necesarios, en el cualquier lugar donde se extraigan, transporten, industrialicen y comercialicen, "y a establecer las prohibiciones temporarias, regionales o generales correspondientes, cuando la situación del "fenómeno de la toxina paralizante de los moluscos o "marea roja", lo hagan necesario para resguardo de la "Salud Pública". "Asimismo, los certificados sanitarios que amparan los moluscos (bivalvos y gasterópodos) industrializados, que "se importen, deberán indicar que la materia prima utilizada en la elaboración de los mismos tenía un título "inferior a CUATROCIENTAS (400) UNIDADES RATON (U.R.) de (T.P.M.), previo a su procesamiento".
