1 10 5623 https://biblioteca.senasa.gob.ar/files/original/ba3a9d5f62817a2bcce4ade21cbbd275.pdf 86fdade26772a390aac6d002ab467907 PDF Text Text https://www.boletinoficial.gob.ar/#!DetalleNorma/345666/QR MINISTERIO DE ECONOMÍA SECRETARÍA DE AGRICULTURA, GANADERÍA Y PESCA Resolución 135/2026 RESOL-2026-135-APN-SAGYP#MEC Ciudad de Buenos Aires, 06/08/2026 VISTO el Expediente N° EX-2026-74327346- -APN-DGTYA#SENASA, la Ley N° 27.233, los Decretos Nros. 2.126 del 30 de junio de 1971 y sus modificaciones, 1.812 del 29 de septiembre de 1992 y su modificatorio, 1.585 del 19 de diciembre de 1996 y sus modificatorios y 697 del 31 de julio de 2026, la Resolución N° 54 del 30 de abril de 2026 de la SECRETARÍA DE AGRICULTURA, GANADERÍA Y PESCA del MINISTERIO DE ECONOMÍA, la Disposición N° 2978 del 18 de mayo de 2026 de la ADMINISTRACIÓN NACIONAL DE MEDICAMENTOS, ALIMENTOS Y TECNOLOGÍA MÉDICA del MINISTERIO DE SALUD, y CONSIDERANDO: Que por el Artículo 1° de la Resolución N° 54 del 30 de abril de 2026 de la SECRETARÍA DE AGRICULTURA, GANADERÍA Y PESCA del MINISTERIO DE ECONOMÍA, se aprueban los montos arancelarios que por retribución percibe el SERVICIO NACIONAL DE SANIDAD Y CALIDAD AGROALIMENTARIA (SENASA), organismo descentralizado en la órbita de la referida Secretaría, correspondientes a los servicios prestados a terceros por sus distintas unidades organizativas, que se consignan en su Anexo I. Que a su vez por el Decreto N° 697 del 31 de julio de 2026 se unifica todo el sistema de control alimentario del país (producción primaria, industrial y alimentos procesados para consumo final), siendo el SENASA, el organismo con competencias en materia de control, registro y fiscalización de las importaciones de productos alimenticios, concentrando en dicho Servicio Nacional las funciones que se encontraban distribuidas entre distintas autoridades sanitarias. Que el referido Servicio Nacional, elevó la propuesta de modificación sobre el régimen de percepción de tasas, derechos, aranceles y contribuciones, en el marco de las competencias establecidas por el Artículo 8º, inciso j) del Decreto Nº 1.585 del 19 de diciembre de 1996, sustituido por el Artículo 9º de su similar Nº 825 del 10 de junio de 2010, a fin de incorporar a la citada Resolución N° 54/26, nuevos aranceles como contraprestación de los servicios realizados a terceros, en virtud del dictado del referido Decreto N° 697/26. Que estos aranceles que se propician incorporar se encontraban oportunamente establecidos en la Disposición N° 2978 del 18 de mayo de 2026 de la ADMINISTRACIÓN NACIONAL DE MEDICAMENTOS, ALIMENTOS Y 1 de 3 �https://www.boletinoficial.gob.ar/#!DetalleNorma/345666/QR TECNOLOGÍA MÉDICA del MINISTERIO DE SALUD. Que en ese sentido cabe resaltar que por el Artículo 30 del citado Decreto N° 697/26 se sustituye el Artículo 19 del Decreto N° 1.812 del 29 de septiembre de 1992 y su modificatorio, el que estatuye que el referido Servicio Nacional “(…) establecerá los aranceles o tasas a cobrar por los servicios de registro de los productos alimentarios. Los importes que se fijen serán uniformes en todo el país, conforme con el criterio de organización del artículo 7° de la Ley N° 18.284 y su aplicación se efectivizará a través de la autoridad sanitaria que resulte competente en cada jurisdicción.”. Que, en consecuencia, corresponde incorporar al Anexo I de la mencionada Resolución N° 54/26, los aranceles que se consignan en el Anexo (IF-2026-75681554-APN-DSAYF#SENASA) que forma parte integrante del presente acto, toda vez que la citada Disposición 2978/26 no resultaría operativa en virtud de la modificación formulada por el Decreto N° 697/26. Que la medida que se propicia no limita la capacidad de respuesta del citado Servicio Nacional para dar cumplimiento a sus misiones y funciones. Que ha tomado intervención el servicio jurídico competente. Que el suscripto es competente para resolver la presente medida, de conformidad con las facultades conferidas por el Decreto N° 50 del 19 de diciembre de 2019 y sus modificatorios, y atento lo establecido en el Decreto N° 101 del 16 de enero de 1985 y sus modificatorios. Por ello, EL SECRETARIO DE AGRICULTURA, GANADERÍA Y PESCA RESUELVE: ARTÍCULO 1º.- Incorpóranse al Anexo I de la Resolución N° 54 del 30 de abril de 2026 de la SECRETARÍA DE AGRICULTURA, GANADERÍA Y PESCA del MINISTERIO DE ECONOMÍA los montos arancelarios que por retribución percibe el SERVICIO NACIONAL DE SANIDAD Y CALIDAD AGROALIMENTARIA, organismo descentralizado en la órbita de la referida Secretaría, correspondientes a los servicios prestados a terceros, que se consignan en el Anexo (IF-2026-75681554-APN-DSAYF#SENASA) que forma parte integrante de la presente resolución, por las razones expuestas en los considerandos de la presente medida. ARTÍCULO 2º.- El producido de los montos por contraprestación de la totalidad de los servicios que se establecen por la presente resolución, deberá ingresar a la Cuenta Recaudadora del referido Servicio Nacional, habilitada a tal efecto por la SECRETARÍA DE HACIENDA del citado Ministerio. ARTÍCULO 3º.- La presente resolución entrará en vigencia a partir de su publicación en el Boletín Oficial.
