CONSIDERANDO: Que la Disposición Nº 1 del 5 de enero de 2017 de la Dirección Nacional de Protección Vegetal del SENASA declara como Plagas No Cuarentenarias Reglamentadas (PNCR) Citrus Tristeza Virus (CTV),Citrus Exocortis Virus (CEV), Citrus Psorosis Virus (CPVs) , Xanthmonas axonopodis pv citri (Cancrosis de los cítricos), y Xyllela fastidiosa pv. pauca (Clorosis Variegada de los Cítricos). Que dicha Disposición surgió de la necesidad de declarar las plagas mencionadas como Plagas No Cuarentenarias Reglamentadas (PNCR). Que habiéndose deslizado un error material involuntario, en virtud de una omisión en la mentada Disposición DNPV Nº 1/2017, corresponde proceder en consecuencia, en virtud de lo prescrito por el artículo 101 del Decreto Nº 1759 de fecha 3 de abril de 1972, t.o. 1991, reglamentario de la Ley de Procedimientos Administrativos Nº 19.549. Que la Dirección de Asuntos Jurídicos ha tomado la intervención que le compete. Que la presente disposición se dicta en ejercicio de las facultades conferidas por el Artículo 4° de la Resolución N° 248 del 23 de junio de 2003 del SENASA y el artículo 101 del Decreto Nº 1759 de fecha 3 de abril de 1972, t.o. 1991, reglamentario de la Ley de Procedimientos Administrativos Nº 19.549. Por ello, EL DIRECTOR NACIONAL DE PROTECCIÓN VEGETAL DISPONE: ARTÍCULO 1°- Sustitución. Se sustituye el artículo 1º de la Disposición Nº 1 del 5 de enero de 2017 de la Dirección Nacional de Protección Vegetal, el que queda redactado de la siguiente manera: “ARTÍCULO 1° – Declaración: Se declaran como Plagas No Cuarentenarias Reglamentadas (PNCR) a : Citrus tristeza virus (CTV), agente causal de la Tristeza de los Cítricos, Citrus exocortis viroid (CEVd), agente causal de la Exocortis de los Cítricos, Citrus psorosis virus (CPsV), agente causal de la Psorosis de los Cítricos, Xanthomonas axonopodis subespecie citri, agente causal de la Cancrosis de los Cítricos, y Xylella fastidiosa subespecie pauca, agente causal de la Clorosis Variegada de los Cítricos.” ARTÍCULO 2° – Vigencia.
